An Albert Lea man sentenced to probation last year for sexually abusing a young child was sentenced to 60 days in the Freeborn County Jail on Monday for violating his probation.

Freeborn County Attorney Craig Nelson said Leo John Kobinski, 42, was reportedly not cooperating with his sex offender treatment, which was one of the conditions of his probation. Because this was Kobinski’s first violation, his probation agent recommended jail time.

Nelson said after Kobinski completes his sentence, he will be placed back on probation and ordered to re-enter and follow treatment.

If he does not stay in treatment and cooperate with the recommendations a second time, he may have to fulfill a four-year prison sentence.

Kobinski pleaded guilty in April 2011 to one count of second-degree criminal sexual conduct with a young child.

Court documents state the abuse was reported the year before by a social worker with the Dakota County Department of Human Services. The alleged acts reportedly took place in late 2009 and early 2010.

When interviewed by a local police detective, Kobinski initially denied any sexual contact with the child. However, he later admitted to inappropriate touching and other contact. He reportedly stated the actions were not forced on the child.
