A Hollandale man charged with having two wives pleaded guilty on Friday in Freeborn County District Court to one felony count of bigamy.

Wayne Allen DeMay, 41, entered the plea as part of a plea agreement between his public defender and the Freeborn County Attorney’s Office.

The plea was classified as an Alford plea, in which a defendant maintains his innocence but admits the prosecutor has enough evidence to convict, usually for stiffer penalties.

According to court files and to marriage records, DeMay and Constance Ann Flim were married May 1, 2010, even though DeMay never divorced Brigette Ann Beaumont, whom he married Feb. 19, 2003.

The DeMay-Flim application for a marriage license showed the couple marked that DeMay had never had a prior marriage, even though records from Madison County, Ky., showed otherwise.

Court records state authorities were alerted to DeMay after Beaumont — still under the name Brigette Ann DeMay — in November reportedly discovered her husband had remarried. She was tracking him down because she wanted a divorce so she could remarry.

The woman told authorities DeMay had left 26 days after their marriage and had not been heard from since.

In court Friday, Freeborn County Attorney Craig Nelson said the divorce has since been finalized and that DeMay’s marriage to Flim was not legal either.

Steve Schwab sentenced DeMay to one year of unsupervised probation and stated if DeMay violated his probation he could face 30 days in jail. He must also pay $80 in court costs.
