It is a law that states that the river has to have a safe access above and below the dam for the public to use the publics rescource.

'1) If this is a Privately own'ed DAM, then why would the County, DNR or Watershed Board repair or replace it?
This question above is really good.
Why not let jensen repair his dam? Since he said that he owns it.
Just repair it and bill/assess jensen for the cost.
But guess what, he will have to allow for a "safe public access to the public waters".

The DNR said that there is a law that states that there has to be a safe access around the dam on public waters, which means that no fence can be erected to stop access to the river. jensen would be violating state laws by preventing anyone to access the river by going around the dam because of a fence.
It does not matter what "deal" that jensen makes with the county, there will be a safe public access around the dam and the state will see to that.

The county commissioners that voted against the dam project should resign.
This is their (the county's/public's) dam why would they not want to fix it now? Are they skeered of a court battle with jensen?

What is the county doing?
The dam is the county's responsibility since the county owns it, they will have to rebuild a dam anyway even if it is down the road. But it sure would be cheaper to do it all at once.
If their plan is to give the county dam to jensen there will still have to be a safe access for the public to use the river.

The DNR should also insist that there must be a public access to that river, its a wonderful resource for fishing, hunting and canoeing.
This would be a perfect time to add a small access after the dam.
Yes use eminent domain to get neough land for this access if Greg will not allow it. Its too important to let slip by and not let the public have access to this river.

The slap on the wrist is from the fact that the county att KNOWS the perps family's parents.
Bottom line here is that criag nelson should remove himself from this court case because of this. The new procecuter should re-charge them with the correct charges and then go to trial.
