Sentencing for Konrad delayed

The sentencing of former Albert Lea High School band director Russell Allan Konrad scheduled has been postponed because of a pre-sentencing investigation recommending a harsher sentence than state guidelines.

The sentencing of former Albert Lea High School band director Russell Allan Konrad scheduled has been postponed because of a pre-sentencing investigation recommending a harsher sentence than state guidelines.

Last November, a jury found Konrad guilty of a fourth-degree sexual conduct with a student. Judge James Broberg was supposed to sentence Konrad Friday.

The Minnesota Department of Corrections conducted the pre-sentence investigation and a sex offender evaluation on the case, and recommended the upward departure from the one-year-and-one-day stayed sentence guideline.

The investigation examined Konrad’s amenability to a treatment program. But, according to County Attorney Craig Nelson, Konrad did not show a willingness to comply with such a program. The court may consider prison time based on the recommendation, Nelson said.

The sentence will be given after a sentencing hearing where Konrad will contest the upward departure.
