The last defendant in an assault on a pizza delivery driver received a stayed prison sentence.
County District Court Judge James Broberg ordered Juan Miguel Sanchez, 19, to serve one year and a day in prison with a stay of execution last week. Sanchez will be under probation for up to five years.
Sanchez, with Jason Sokolofsky, Sandra Banuelos and two other juveniles, lured the Domino’s Pizza delivery person by placing an order to a residence on West 11th Street in May of 2002. Sanchez and two juveniles went out of the car and attacked the driver with an axe handle, and took $16.10 and a pizza.
Sanchez was charged with first-degree aggravated robbery. But that accusation was dismissed in a plea agreement. Instead, he pleaded guilty to aiding and abetting a theft.
Testimony gathered from the group could not pin down the person who assaulted the victim.
The court will continue this case with a hearing for restitution for the victim.
