Suspect in standoff charged with assault

The Freeborn County Attorney’s Office charged Barry Alan Tolbers, who led police into a weekend standoff that shook his neighborhood, with first-degree assault Monday.
Tolbers, 47, is in custody at the county jail on $150,000 bail, or $100,000 with conditions, after receiving treatment at Albert Lea Medical Center for an injury caused by non-lethal bullets used by the police when they apprehended him Sunday morning.
Investigators seized three handguns, three shotguns and one rifle with more than 1,000 rounds of ammunition from the house at 809 Harding Ave., where Tolbers confined himself surrounded by an army of police for more than 10 hours.
The police made the decision to use tear gas to force the shooter out of the house Sunday morning, after a last attempt to persuade Tolbers failed.
&uot;We realized we don’t want to wait for the daylight,&uot; Assistant Police Chief Dwaine Winkels said.
The police shot Tolbers with the reduced-power bullets at the back door. He once went back into the house, but returned outside to run away from the gas, and then another shot knocked him down. Tolbers had a shoulder holster with a loaded handgun.
Tolbers fired at least 69 times while in the house, mostly the .357 Magnum and shotgun. Twenty-three bullets hit neighboring houses, street lamps and squad cars, the police said.
A family evacuated to their basement in a nearby house decided run away from the home after one bullet penetrated their wall and destroyed a picture stand and glass table, said Lt. Glen Larson, who took command at the scene.
Tolbers’ motive is still unknown. But, the information given to the police suggests that he has been disturbed by the loss of a family member. The utilities for the house have been shut off for a while, according to the investigation.
