Five businesses fail compliance checks

On Saturday the Albert Lea Police Department conducted a round of tobacco compliance checks throughout the city.

There were five illegal sales made to minors, compared to three illegal sales last year.

Minors under the age of 18 years old were sent into 29 businesses to attempt to purchase tobacco products.

According to police reports, businesses that failed the checks were identified as: Book World, Freeborn County Co-op Oil Co., Shell Food Mart, Southtown Liquor and Nelson&8217;s Market Place.

The 1997 Minnesota State Youth Access Law requires law enforcement agencies to conduct compliance checks at least once a year. Retail clerks who sell tobacco to minors are issued citations for the first violation, which carries a maximum penalty of not more than 90 days in jail and a fine of not more than $1,000. A second violation by the same clerk within a five year period is a gross misdemeanor violation. Administrative penalties of up to $250 per day and a seven day suspension of their tobacco license can be assessed to businesses for failing tobacco compliance checks, said Lt. Phil Bartusek of the Albert Lea Police Department.

Two arrested for possession

Chad Lutcavish, 28, and Kristin Minert, 30 were arrested for fifth degree possession on Saturday at 1:07 a.m. on County Road 46 and Interstate 35. Lutcavish also had no drivers license, and Minert was also arrested for allowing illegal operation and allowing a scanner in the vehicle and possession of drug paraphernalia, according to police reports.

Two men arrested for DWI

Antonio Flores, 27, was arrested for fourth degree DWI on Friday at 11:22 p.m. He was also cited for not having a Minnesota drivers license and failing to stop at a stop sign, according to police reports.

At 2:14 a.m. on Saturday, Richard Bauman, 55, was cited for fourth degree DWI near the 1700 block on Southview Lane.

Woman cited for driving with suspended license

Jamie Kittle, 22, was cited for driving after the suspension of her license on Saturday at 11:43 p.m. near the 100 block of Broadway Avenue North, according to police reports.
