Winnebago County Attorney Robert Cooper said Wednesday that his office is looking into whether charges should be amended for Timothy Patrick Winter, the Lake Mills, Iowa, man charged with attempted murder of his mother in April.
This comes after the mother, Cynthia Winter, 63, died in her home on Monday.
It is not yet clear whether her death was connected to the incident months prior, when she sustained severe head injuries after she was allegedly beaten in the head with a hammer by her son.
Cooper said a lot of the decision about whether to amend the charges will be based on information given by physicians, which may take a few weeks to receive.
Meanwhile, a motion is still in effect to determine whether Timothy Winter, 36, is competent to stand trial on the charges. This was motioned in June.
Cooper said he did not know when this determination would be made.
Timothy Winter was arrested April 10, about three hours away from Winnebago County. The alleged incident took place the night before.
According to Winnebago County court records, an officer responding to the 911 call at the Winter home described Cynthia Winter as having a large bruise on the side of her face and bleeding profusely.
The officer stated when the woman turned around, he witnessed “a severe wound on the back of her head with muscle and skull exposed,” according to documents.
The mother told the officer that her son had struck her several times with an unknown object, documents state.
Officers later discovered a hammer covered with blood, hair and skin.
Funeral services for Cynthia Winter will be today at 1:30 p.m. at Salem Lutheran Church in Lake Mills.
