Freeborn County District Court Judge Steve Schwab on Monday sentenced 21-year-old Lance David O’Reilly of Albert Lea to 51 months in prison for criminal sexual conduct with a 15-year-old girl.
O’Reilly pleaded guilty to one count of third-degree criminal sexual conduct earlier this month in what was classified as an Alford plea, in which a defendant maintains his innocence but enters the plea because he knows there is sufficient evidence for conviction.
He originally faced two counts of second-degree criminal sexual conduct; however, in the agreement one of the counts was dropped and the other was amended to a third-degree level.
According to court documents, O’Reilly initially met the teenage girl involved in the case over social network site MySpace in September 2007. They met in person about a month later and became boyfriend and girlfriend. She later became pregnant.
He was 18 at the time of the alleged sexual contact and intercourse.
O’Reilly’s sentence will run concurrent with an unrelated prison sentence he is currently serving in Faribault. On that sentence — for simple robbery — he was sentenced to 23 months. He began the sentence June 1 and is getting credit for 187 days.
On the criminal sexual conduct charge, he is getting credit for 326 days, already served.
After he is released from prison he will be on conditional release for 10 years.
