I recently moved from Albert Lea Housing and Redevelopment housing. Approximately four weeks after I moved, I inquired about my deposits. I was told it would be mailed this week. I got a call from my Department of Human Services worker stating they were withholding both security and pet deposits for damages and that I owe just over $66. I looked up Minnesota tenant/landlord law and found that if a landlord doesn’t send notice of withholding or release the damage deposit within 21 days, they owe the tenant double the amounts plus non-compounded interest.
I called them on the issue and was told that I would receive double my deposits. I got one back but have to take them to court for the other. I have had to take HRA to court for money due for not having a shower for two years.
Know your rights! It is up to you to look into what a landlord is trying to do to you and what is legal, and please read your lease! Some leases, including our local HRA, have items in the lease that might be outdated and illegal. Landlords have rules to follow as well as the tenant.
