New Richland man charged with criminal sexual conduct

A New Richland man is facing prison time after being charged with first-degree criminal sexual conduct.

Donald Louie Mortenson, 48, was charged Friday in Freeborn County District Court tied to an incident Oct. 17.

According to court records, the alleged victim, an adult woman, spoke to detectives with the Albert Lea Police Department and Freeborn County Sheriff’s Office on Nov. 24 at the Freeborn County Law Enforcement Center. She said she had been at the home of Mortenson on the evening of Oct. 17, overnight until Oct. 18.

She said she and Mortenson eventually went into his bedroom.

Mortenson allegedly sexually assaulted the woman.

She said she had recently gone through surgery and may need surgery again after the incident.

Mortenson was interviewed Wednesday. He reportedly confirmed that the woman had stayed at his home that night. When asked if the sexual encounter was consensual, he reportedly said, “I think so. I didn’t pull her into my room or bed. She walked right in and laid next to me.”

He reportedly said he only remembered half of the evening and didn’t remember her saying “no,” or pushing him off the bed. He reportedly admitted that he knew she had been recovering from surgery.

District Court Judge Larry Collins set conditional bail at $90,000, contingent on Mortenson not consuming alcohol or a controlled substance, having no contact with the alleged victim, possessing no alcohol or drugs and fulfilling other court requirements.

He is next slated to appear in court Dec. 17.
