An Albert Lea man is facing charges after he reportedly shot a gun at his sister’s car as she attempted to leave a house with her son following an argument.
Jacob Allen Dale, 21, was charged with second-degree assault with a dangerous weapon and intentionally discharging a firearm that endangered another.
According to court documents, police responded to a report of a gunshot fired Sunday from a residence on Clayton Avenue in Albert Lea. The reporting party also said that a female was sobbing at the residence earlier.
On the way to the residence, an officer saw a male who matched the description of the individual involved, who was jogging along the tree line off of 19th Street. He at first kept running but later tripped and was arrested and handcuffed.
Court documents stated a woman who lived at the house with Dale told police that he had too much to drink and had gotten into a fight with his sister, in which they had hit one another. When asked whether anyone had fired a gun, she confirmed that Dale had done so.
A black semi-automatic handgun was sitting on the nightstand in the bedroom when police were at the residence. The woman said she had moved it to the nightstand after Dale had left it on the bed.
The alleged victim told police that her son was crying and that she had to take him somewhere safe. She confirmed that Dale had shot through her window.
An officer found a shell-casing on the ground directly in front of Dale’s vehicle, and it was found to be the same as the ammunition in the gun.
Officers found tire scuff marks that were consistent with a vehicle spinning its tires while having to leave quickly. Shattered glass was also on the ground.
When police interviewed Dale, he at first denied shooting his gun, but when police told him about the witnesses and evidence in the case, he said he didn’t shoot at a moving vehicle and that it had been parked when he shot at it.
He said he had been fighting with another individual, and later reportedly admitted to going out to his car, getting his gun and then shooting at the vehicle. He said he tried to shoot at the windshield to get them to leave and said they didn’t start backing out until after the shot was fired.
