Former Albert Lea teacher pleads guilty to solicitation of child

A former Albert Lea school district teacher pleaded guilty Friday in Freeborn County District Court to electronic solicitation of a child in May 2024. 

Gerardo Noe Guerrero, 32, pleaded guilty to two counts of distributing via electronic communication material that describes sexual conduct to a child tied to incidents from May 2024. Three other counts are expected to be dismissed as part of a plea agreement with the Freeborn County Attorney’s Office. 

Guerrero, of Austin, was most recently a physical education teacher at Southwest Middle School but during the 2023-24 school year worked as a substitute teacher at Albert Lea High School.

Court documents state Guerrero reportedly found a student he had met at the high school on Instagram and Snapchat and then began sending her photos and a video, some that were sexual in nature. 

His plea petition stated that in exchanged for the guilty plea, the prosecutor would agree to a 90-day jail cap. He would have to complete a psychosexual evaluation and follow predatory offender registration requirements and would not be allowed to have contact with minors except for his own children unless the psychosexual evaluation indicates no contact or supervision. He also has to complete a mental health evaluation and follow other recommendations of the pre-sentence investigation. 

Whether he will receive a stay of execution or stay of imposition would be open for argument. 

Guerrero is slated to be sentenced Aug. 29.
