Will suspected arsonist change plea?

A plea change hearing has been scheduled for Tuesday in Winnebago County District Court for the Lake Mills, Iowa, man charged with arson of a home and van in Lake Mills in April.

Larry Dick Smit, 46, pleaded not guilty to two counts of second-degree arson, both felonies, earlier this month, tied to the fire at 102 N. Fourth Ave. W in Lake Mills on April 7.

A plea change hearing typically denotes that a defendant is planning to change his plea from not guilty to guilty, according to a Winnebago County court clerk. If this takes place, Smit could be sentenced that same day or at a later date.

The hearing is scheduled to begin at 10 a.m.

Smit was arrested April 7, shortly after authorities received a call of the blaze on the corner of Fourth Avenue and Lake Street. By the time firefighters arrived, the house and a Plymouth Voyager minivan were engulfed in flames.

Firefighters reportedly encountered Smit, who was described as “a man who was disturbed” and who would not let them fight the fire.

After police arrived at the scene, Smit was subdued with a Taser and arrested.

Smit has also been charged with two counts of interference with official acts — one for allegedly interfering with the firefighters who tried to put out the blaze and one for allegedly resisting arrest by Lake Mills police — along with one count of possession of drug paraphernalia.

Court dates have not been scheduled.
