Pornographer gets probation

A Glenville man was sentenced to 10 years of probation last week for taking sexually explicit photos of a young girl and then distributing them online.

If Brandon Davis Franksain, 28, violates his probation, he could face two years in prison for a charge of using minors in a sexual performance or pornographic work and three years for a charge of dissemination, said Freeborn County Attorney Craig Nelson. The time would be spent concurrently.

Nelson said Franksain had no prior criminal history, and Freeborn County District Court Judge Steve Schwab followed the sentencing recommendations given in the presentence investigation.

The images were found on Franksain’s cell phone last October. He had reportedly been sending the images via a chatting website. In a police interview in January, Franksain reportedly admitted to taking photos of the girl and stated he traded child pornography pictures with another person.

He pleaded guilty to the two charges in April, and a third charge of possessing pornographic work was dismissed.

Schwab ordered Franksain to register as a predatory offender and have no contact with minors in a private setting unless approved by his probation agent. He also cannot access or use the Internet without prior approval.

He received credit for 73 days spent in the Freeborn County jail.
