Child pornographer gets 3 years

A Glenville man convicted of taking sexually explicit photos of a young girl and then distributing them online was sentenced last week to three years in prison.

Brandon Davis Franksain, 28, was accused of violating his probation, but rather than appear for a hearing on the violation, Franksain requested he serve the prison term, said Assistant Freeborn County Attorney David Walker.

Franksain will receive credit for 85 days already spent in the Freeborn County jail.

According to court documents, Judge Steve Schwab sentenced Franksain in July to 10 years of probation for a charge of using minors in a sexual performance or pornographic work and then disseminating the photos. Part of his sentence was that if he violated his probation, he could have to serve the prison time.

Walker said after Franksain is released, he will be on conditional release for five years. He will have to register as a predatory offender.

The images were found on Franksain’s cellphone last October. He had been trading the photos via a chatting website.

Leuning ordered Franksain to pay a $380 fine.
