Truck driver seeks dismissal of murder charge

HOPKINSVILLE, Ky. — A Minnesota truck driver charged with murder in a May wreck on Interstate 24 is seeking to have the charges against him dismissed on grounds police didn’t have probable cause to arrest him.
Fifty-year-old Timothy Baldwin of Monticello, also wants to have a blood test excluded from his trial.
Baldwin faces a May 12 trial in the death of 69-year-old Harold Johnson. Johnson’s SUV was rear-ended by Baldwin’s tractor-trailer. Police believe Baldwin was under the influence of methamphetamine and other drugs at the time.
Johnson and his wife Louise were taken to Gateway Medical Center in Clarksville, but Harold Johnson was pronounced dead on arrival.
Baldwin is being held at the Christian County Jail on a $1 million bond.
