School officials accused of not reporting janitor

ST. PAUL — Two former officials at a St. Paul school were charged Monday with failing to report a custodian’s alleged sexual misconduct against a student.
Beth Behnke, 48, of Burnsville, was principal and Craig Guidry, 52, of Arden Hills, was assistant principal at Linwood Monroe Arts Plus School in 2011 when custodian Walter Happel allegedly followed a boy into a bathroom.
Behnke and Guidry were both charged in Ramsey County with one count each of misdemeanor failure to report the maltreatment of minors. The Dakota County Attorney’s office reviewed and charged the cases to avoid a possible conflict of interest.
“Mandated reporters are required to file reports within 24 hours of their direct observations or indirect information they receive related to the neglect or sexual abuse of a child,” Dakota County Attorney James Backstrom said in a statement Monday.
In February, another student told staff that Happel peeked at him in a bathroom stall. The school reported that incident to police, which resulted in charges against Happel. That prompted other alleged abuse victims to contact police and led to a review of how the district handled earlier allegations against Happel.
A school district spokeswoman, Julie Schultz Brown, said on Monday the district had not seen the charges and could not comment.
In May, St. Paul schools CEO Michelle Walker said the Happel case is prompting the district to revise its reporting and communication practices.
Guidry is now an assistant principal at Jackson Elementary in the St. Paul school district while Behnke is principal at Falcon Heights Elementary School in Roseville Area Schools. Phone messages left after hours at Behnke’s and Guidry’s offices were not immediately returned Monday evening. The two also did not immediately respond to emails late Monday or to requests for comment from the newspaper.
According to the complaint, in December 2011 a student’s mother reported to the police that Happel followed her son into the bathroom. The mother told police that she reported the incident to the school but didn’t hear from the school for four weeks. She then decided to bring the case to police.
Happel, 62, resigned as custodian in late February. He faces eight charges of sexual misconduct, most of which involve inappropriate behavior with students. Six of his alleged victims are students at Linwood Monroe.
Happel began working for the district in 1984. He has pleaded not guilty.
