Attorney: Charges not warranted in BCA shooting

MINNEAPOLIS — The Douglas County Attorney says criminal charges aren’t warranted against two Bureau of Criminal Apprehension agents in the shooting death of a man during an undercover investigation.

County Attorney Chad Larson said Friday that agents Elizabeth Eilers and Dustin Van der Hagen acted in self-defense in the death of 31-year-old Adam Jo Klimek.

Officials said that BCA agents were in Alexandria on Aug. 2 working an undercover operation to apprehend sex offenders targeting minors when they tried to arrest Klimek. Authorities said Eilers and Van der Hagen shot at Klimek as he approached with a knife.

Larson said three video recordings show that the agents’ fear for their lives before discharging their weapons was reasonable. He says the evidence shows Klimek intended to cause his own death by threatening authorities.
