Judge orders lesser sentence than minimum term
An Albert Lea man who injured a person during a fall 2015 robbery was sentenced to nearly three years in prison Thursday in Freeborn County District Court.
Isaiah Ray Talamantes, 22, was sentenced by Judge Steven Schwab after he pleaded guilty to first-degree aggravated robbery in October. He was given credit for 226 days served.
He will serve his sentence at the Minnesota Correctional Facility in St. Cloud.
Schwab ordered a downward durational departure, resulting in Talamantes receiving a lesser sentence than the approximately 5 1/2 year minimum term Freeborn County Attorney David Walker requested.
Court documents state Talamantes was charged after the victim — whom Talamantes knew — said a van pulled up and parked ahead of him Oct. 10, 2015, as he was traveling north on Euclid Avenue. Talamantes approached the victim, punched him in the face and threatened to severely harm or kill him. He reportedly told the victim to give him his iPhone and wallet. After receiving the items, Talamantes emptied the wallet of cash, a gift card and a rewards card before he dropped the wallet on the ground.
The victim sustained redness and swelling around his eye.
In a separate file, Talamantes was charged with felony motor vehicle theft and felony unauthorized use of a motor vehicle, but those counts were dismissed at sentencing.
