Albert Lea man gets years of probation for 2016 assault

An Albert Lea man who struck another man in the face in April 2016 was placed on probation for up to five years Friday in Freeborn County District Court.

Cody Shawn Rhyns, 47, was sentenced after he pleaded guilty in January to third-degree assault. He was given a stayed sentence of nearly two years in prison and was sentenced to 40 days in jail, all of which he was given credit for.

While on probation, he will not be allowed to vote, engage in assaultive behavior or contact the victim. He must submit to random testing and complete a chemical assessment and cognitive skill training.

Court documents state Rhyns was charged after he stole cocaine from a neighbor. The victim confronted Rhyns about the theft.

Rhyns admitted answering the door and striking the victim in the face. When the door opened, another man, identified as Donald Maurice McCormick, reportedly pointed a rifle at the victim.

The victim suffered an injury to his left eyebrow.

Rhyns was charged with being an ineligible person in possession of a firearm, but that charge was dismissed.

McCormick pleaded guilty to assisting Rhyns in the assault and was placed on probation for up to five years in September 2016 after pleading guilty earlier that year to terroristic threats.
