ARTICLE 1. – IN GENERAL

ORDINANCE

THE CITY COUNCIL OF ALBERT LEA, MINNESOTA ORDAINS:
CHAPTER 4 – ALCOHOLIC BEVERAGES – ARTICLE I. – IN GENERAL
Sec. 4.001. – Definitions.
Cannabis is a dried preparation of the flowering tops or other parts of the cannabis plant, or a resinous extract of it (cannabis resin), smoked or consumed. Also called hemp, marijuana.
Tetrahydrocannabinol (THC) Beverage is a drink infused with psychoactive THC, the intoxicating substance in cannabis.
Sec. 4.006. – Open Bottle.
It is unlawful for a person to drink or consume, or have in possession any unsealed bottle or receptacle containing alcoholic or cannabis/THC beverages, distilled spirit, or 3.2 percent malt liquor on any street or other public property or private parking lot to which the public has access, except as licensed or signposted by the council. This section shall not apply to the possession of an unsealed container in a motor vehicle, on streets or public property, when the container is kept in the trunk of such vehicle (if it is equipped with a trunk), or kept in some other area of the vehicle not normally occupied by the driver or passengers, if the motor vehicle is not equipped with a trunk. For the purpose of this section, a utility or glove compartment shall be deemed to be within the area occupied by the driver or passengers.
That the motion for the adoption of the foregoing ordinance was duly seconded by Councilor R. Rasmussen, and upon a vote being taken thereon, the following voted in favor thereof: Councilors Christensen, Baker, R. Rasmussen, Anderson and Mayor Murray. And, the following voted against the same: Councilors Howland and S. Rasmussen. Mayor Murray declared the ordinance passed.
